The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:30 p.m. on Tuesday, December 8, 2009 at City Hall in Henderson, Nebraska.

Notice of this meeting was posted at the City Hall and published in the December 3, 2009 Henderson News. Mayor Ken Bergen called the meeting to order at 7:30 p.m. Mayor Bergen declared the meeting to be legal and properly advertised with all members having been informed of the nature of the meeting and having received related information. Mayor Bergen also referred to the open meetings law poster at the back of the council chambers.

Roll call showed the following present: Mayor Ken Bergen. Council members: Jim Mestl, Deb Friesen and Matt Friesen. Absent: Scott Erb. Also present were the city clerk and police chief.

Minutes from the November 10, 2009 meeting were reviewed. Jim Mestl made a motion to approve the minutes as presented with a change adding Deb Friesen as absent for the vote on claims. Matt Friesen seconded. Roll vote: Ayes - Jim Mestl, Matt Friesen and Deb Friesen. Absent: Scott Erb. Motion carried.

Claims were reviewed. Jim Mestl made a motion to approve the claims as presented. Deb Friesen seconded. Roll vote: Ayes - Matt Friesen, Deb Friesen and Jim Mestl. Absent: Scott Erb. Motion carried.

One building permit was submitted.

Deb Friesen made a motion to accept the recommendation of the Mayor for the 2010 appointments. Jim Mestl seconded. Roll vote: Ayes - Deb Friesen, Jim Mestl and Matt Friesen. Absent: Scott Erb. Motion carried.

Jim Mestl made a motion to table water/sewer rates until January meeting. Matt Friesen seconded. Roll vote: Ayes - Jim Mestl, Matt Friesen and Deb Friesen. Absent: Scott Erb. Motion carried.

After discussion, Matt Friesen made a motion to accept the recommendation of the Mayor to appoint Harold Andres as a new commissioner for the Housing Authority. Deb Friesen seconded. Roll vote: Ayes - Matt Friesen, Deb Friesen and Jim Mestl. Absent: Scott Erb. Motion carried.

Jim Mestl made a motion to have attorney amend the ordinance concerning the Board of Adjustments and Planning Commission Board in the Municipal Code Book. Matt Friesen seconded. Roll vote: Ayes - Jim Mestl, Matt Friesen and Deb Friesen. Absent: Scott Erb. Motion carried.  

After discussion and recommendation by city auditors, Matt Friesen made a motion to adopt a policy to have fixed asset depreciation set for $5,000. Deb Friesen seconded. Roll vote: Ayes - Matt Friesen, Deb Friesen and Jim Mestl. Absent: Scott Erb. Motion carried.

Reports were given. No formal action taken.
