Article 7. Penal Provision

§12-701             VIOLATION; PENALTY. (1) Any person who shall violate or refuse to comply with the enforcement of any of the provisions of this Chapter, set forth at full length herein or incorporated by reference shall be deemed guilty of an offense and upon conviction thereof, shall be fined not more than one hundred dollars ($100.00) for each offense. A new violation shall be deemed to have been committed every twenty-four (24) hours of such failure to comply.

             (2)        The owner or tenant of any building, structure, premises, or part thereof, and any architect, builder, contractor, agent, or other person who commits, participates in, assists in, or maintains such violation may each be found guilty of a separate offense and suffer the penalties herein provided.

             (3)        Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation.
