ADDITIONS AND CITY LIMITS


Article 1. Additions


§11-101             ORIGINAL PLAT, PLATS, ADDITIONS, SUBDIVISIONS, OUTLOTS, APPROVED. Each and all plots, lots, blocks, additions, subdivisions, outlots and parcels of ground included within the corporate limits of the City of Henderson, Nebraska, and not vacated of record prior to the enactment of this chapter, including the original plat of the city, are hereby accepted, approved and confirmed as valid, and each and all of said lots, blocks, additions, subdivisions and outlots as heretofore platted and recorded in the office of the County Clerk of York County, Nebraska, and not heretofore vacated, and all other parcels of ground included within said corporate limits, are hereby declared to be within the city.


§11-102             LAYING OUT ADDITIONS OR SUBDIVISIONS; CONDITIONS. The owner of any tracts or parcels of land within the corporate limits of the city or contiguous thereto, who shall subdivide the same into two or more parts for the purpose of laying out any addition to the city, shall cause a plat of such subdivision to be made and filed for record in conformance with the laws of Nebraska. §11-103             ADDITIONS OR SUBDIVISIONS; STREETS, AVENUES AND ALLEYS. The streets, avenues and alleys in all tracts or parcels of land, hereafter subdivided or laid out as an addition or which may heretofore have been subdivided or laid out as an addition but not submitted to or approved by the Mayor and Council, shall correspond in width and direction and be continuations of the streets, avenues and alleys of the city or any addition contiguous to or near the proposed addition. §11-104             ADDITIONS, PLATS, VACATION OF. Any plat or a part thereof of any addition to the city may be vacated by the proprietors thereof, at any time before the sale of lots therein by a written instrument declaring the same to be vacated, duly executed and recorded in conformance with the laws of Nebraska. §11-105             ADDITIONS; APPROVAL BY CITY COUNCIL. No owner of any real property located within one mile of the corporate limits of the City of Henderson, Nebraska, shall be permitted to subdivide, plat or lay out such real property in building lots and streets or other portions of the same intended to be dedicated to public use or for the use of the purchasers or owners of lots adjoining thereon or adjacent thereto without first having obtained the approval thereof by the City Council. The fact that such real property is located in a different county or counties than some or all portions of the municipality shall not be construed as affecting the necessity of obtaining the approval of the City Council. No plat of such real property shall be recorded or of any force or effect unless the same be approved by the City Council; provided, this section shall be construed as prohibiting the use of property within said area for purposes other than those approved by the City Council or those uses existing at the time of the enactment of this Article. §11-106             SUBDIVISION OF LOTS. All those subdivisions created by any instruments effecting the division of a lot, tract, or parcel of land into two or more lots, sites, or other divisions of land for the purpose, whether immediate or future, of ownership, or building development executed after the effective date of this Article, or executed prior to the effective date of this Article but not filed in the office of the Register of Deeds of York County, Nebraska, prior to the effective date of this Article.
